1. Introduction

Welcome to Hockeyfy ("the App"). These Terms of Use ("the Terms") govern your use of the App and the services provided by WS Code AB ("We," "Us," "Our"). By creating an account and using the App, you agree to these Terms.

2. Purpose

The purpose of the App is to film and record movements to analyze strength, speed, and other motion parameters of an object (hockey stick) in order to assess and rate the movement.

3. Privacy and Security

The App does not require additional permissions but, for full functionality, it requires access to the device's camera, media, and push notifications.

4. Collection and Processing of Personal Data

User personal data is processed in accordance with our Privacy Policy and GDPR (General Data Protection Regulation).

5. User's Responsibility

As a user of the App, you are responsible for:

  • Providing accurate and up-to-date information.

  • Protecting your login credentials and not sharing them with others.

  • Not knowingly or negligently uploading content containing viruses or other harmful software.

  • Using the App in a legal manner, as intended, and in accordance with these Terms.

6. Our Rights and Responsibilities

We are committed to:

  • Protecting user personal data in accordance with our Privacy Policy.

  • Providing users with access to support when needed.

7. Termination and Suspension

You can terminate the service at any time by closing your User Account by contacting william.sonesson@hockeyfy.se.
If you terminate the Service, you will no longer have access to the App.
We reserve the right, without prior notice, to suspend or terminate a user's account for violation of these Terms.
We also reserve the right, without prior notice, to terminate a user's account if they have not logged into the App for more than two years.

8. Availability

The App is normally available 24/7. However, we do not guarantee that the App will be uninterrupted or error-free. The service may occasionally be fully or partially unavailable during necessary backups, maintenance, improvements, security updates, or similar actions. We will inform you of such planned interruptions, if possible.

9. Logging

The App logs information about logins, usage, and shot counts.

10. Third-Party Services

WS Code AB does not sell or transfer data from the App to third parties.

11. Intellectual Property Rights

All intellectual property rights in the App, including but not limited to design, logos, and features, belong to us or our licensors. You may not copy, modify, or distribute material from the App. Any violation of intellectual property rights will be handled in accordance with applicable law and determined according to section 12.

12. Limitation of Liability

We are not liable for damages arising from:

  • Incorrect use of the App.

  • Unavailability of the App.

  • Data loss not caused by gross negligence on our part.

13. Changes to the Terms

We reserve the right to change these Terms as necessary. Users will be informed of changes via the App. Continued use of the App means that you, as a user, accept the updated Terms.

15. Applicable Law and Dispute Resolution

These Terms are governed by Swedish law. Any disputes shall primarily be resolved through negotiations and, if necessary, be decided by a Swedish court.

WS Code AB, registration number 559437-8084 ("WS Code", "we", "our", "ourselves", or "us"), is the data controller in accordance with the EU General Data Protection Regulation (GDPR). This Privacy Policy relates to information about our personal data processing in the Hockeyfy app ("the App") and complies with the GDPR. We update and change this information regularly.

What personal data we collect and for what purpose

Personal data refers to any information that can directly or indirectly identify a natural person. This may include name, email address, and images. Personal data processing refers to any action performed on personal data. For processing to be legal, it must be based on a legal ground.

Below is information about the personal data we process, how the data is collected, the purpose for which it is collected, the legal basis for processing, and how long the data is stored.

We process the following personal data in order to provide the App:

  • Name

  • Email address

  • Age

The personal data is collected directly from the user upon account registration. The processing of personal data is necessary to fulfill the agreement between us and the user. The personal data is stored as long as the user has an active account.

We also process personal data in videos taken by our users. The purpose is to use the videos to improve the App. The legal basis for processing is the balancing of interests. We have assessed that we have a legitimate interest in using the material to develop the App, that the processing is necessary to achieve this purpose, and that our interest outweighs your right not to have your data processed for this purpose. The videos are stored for one year.

Your rights

Under the GDPR, you have control over your personal data and the right to be informed about how we process your data. Below, you can read about your rights:

Right to information

You have the right to receive information about how we process personal data. This information is provided in this Privacy Policy.

Right of access

You have the right to request information on whether WS Code AB processes personal data about you, and if so, to receive a copy of this data, also known as a record extract, with further details about our personal data processing.

Right to erasure

You have the right, under certain circumstances, to request the erasure of your personal data. This is also known as the "right to be forgotten."

Right to access and transfer your personal data

This right allows you to request a copy of the personal data we hold about you that we process to fulfill an agreement with you, in a machine-readable format. This is to enable you to use the personal data with another data controller. This right is also known as the right to data portability.

Right to rectification

You have the right to have any inaccurate or incomplete personal data corrected.

Right to restriction of processing

If you believe that the personal data we hold about you is inaccurate, that our processing is unlawful, or that we no longer need the data for a specific purpose, you have the right to request that we restrict our processing of your personal data.

Right to object

You may object to our personal data processing that is based on the balancing of interests as a legal basis.

Recipients of personal data

We may share your personal data with suppliers engaged by WS Code AB for purposes such as storage, development, and optimization of the App. These recipients are only authorized to process personal data on behalf of WS Code in connection with the provision of services. WS Code AB takes reasonable measures to ensure that the recipients of personal data process it securely and with an adequate level of protection. Currently, Google is a recipient of personal data.

Transfer of personal data outside the EU/EEA

We strive to process your personal data within the EU/EEA. However, if that is not possible, we may transfer your personal data to a country outside the EU/EEA. When transferring data outside the EU/EEA, appropriate technical and organizational safeguards are implemented to ensure that your personal data is processed securely and with an adequate level of protection comparable to the protection offered within the EU/EEA.
